Davacılar , Procter And Gamble Lımıted, The Procter And Gamble Company İleDavalı , Namuk Gökçel Alfa Kimya Temizlik Ürünleri Ticaret arasında mahkememizde görülmekte olan Marka (Marka Hakkına Tecavüzden Kaynaklanan) davasına ilişkin yapılan yargılama sonucunda;

” 1-Davanın KABULÜ İLE, davalının kullanımlarının davacı Procter & Gamble Limited adına tescilli 2009/54736 numaralı ve davacı The Procter & Gamble Company adına tescilli 2012/36615 numaralı ve 2014/101602 numaralı marka hakkına tecavüz ve haksız rekabet oluşturduğunun tespitine, marka hakkına tecavüzün ve haksız rekabetin önlenmesine ve sonuçlarının ortadan kaldırılmasına, tecavüz oluşturduğu tespit edilen davalı kullanımlarının bulunduğu bulaşık deterjanı ürünlerinin ve benzerlerinin etiket ve boş şişe dahil her türlü ambalaj ve şişelerinin üretim, satış, pazarlama ve ticari maksatla elde bulundurmasının önlenmesine,
Davacıların yukarıda belirtilen markalarına tecavüz oluşturduğu tespit edilen davalı kullanımlarının bulunduğu ürünlere ve benzerlerine ait şişe, etiket, kalıp, kutu, koli, ambalaj, katalog, broşür, basılı evrak, yazı ve her türlü tanıtım vasıtasına el konulmasına karar kesinleştiğinde imhasına
